GUIDANCE NOTES - PLEASE READ
Your valued custom is important to us and we want to satisfy your purchasing requirements. These Terms and Conditions of Sale ("the Terms") are important to you and to MidwayUK.com ("Midway UK") and should be considered carefully before you place an order with us.
These Terms have been designed to protect your rights as a valued customer, to protect our rights as a business, and to create an understanding between us.
Please note carefully the section which refers to our Returns Procedure, and the section which details our obligations under the Distance Selling Regulations.

GENERAL
For purposes of the Terms "we", "us", "our" refer to Midway UK and "you" and "your" refer to you the Customer unless the context clearly indicates otherwise.
The Terms apply to all transactions carried out on the Midway UK website and through our mail order system. Should this not be the case we will indicate either "this applies to website sales only" or " this applies to mail-order sales only".
All other terms and conditions express or implied by statute or otherwise are excluded to the fullest extent permitted by law but nothing in these terms and conditions shall affect the statutory rights of any consumer except in respect of death or personal injury caused by our negligence, we will not be liable to you, the buyer, for any loss of profit or any indirect special or consequential loss, damage, costs, expenses or other claims, which arise out of or in connection with the supply of our products.
We will not be liable to you for any other claims which arise out of the supply of our products to you unless we are grossly negligent.
We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are grossly negligent, we will not be liable to you for losses as a result of unauthorised access to information provided by you.
We will use all reasonable endeavours to carry out our obligations to you within a reasonable period of time but will not be liable to you, the buyer, for any loss, costs or expenses arising directly or indirectly from any delays in doing so and we will not be deemed to be in breach of our obligations to you by reason of any delay in performing, or any failure to perform, any of our obligations, if the delay or failure was due to any cause beyond our reasonable control. Without prejudice to the generality of the foregoing, the following will be regarded as causes beyond our reasonable control Act of God, explosion, flood, tempest, fire or accident, War or threat of war, sabotage, civil disturbance or requisition, Acts, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority, Import or export regulations or embargoes, Strikes, lock outs or other industrial actions or trade disputes, Difficulties in obtaining raw materials, labour, fuel, parts or machinery, Power failure or breakdown in machinery.
We hereby exclude the application of the Contracts (Rights of Third Parties) Act 1999 to each and every contract made under these Terms. These Terms cannot be altered or suspended, permanently or temporarily, without the written permission of a member of the Board of Directors of Midway UK.
These conditions are subject to English law and the jurisdiction of the English courts.
MAKING A PURCHASE
Making a purchase could not be easier. Just browse our Catalogue, and click on any items that you wish to buy and put them into the shopping cart. After you have finished your selection, click on "Order" and you will be asked for a few details that we need to be able to satisfy the order.
We accept Visa and Mastercard Credit Cards as well as Delta and Switch Debit Cards. You may place your order via phone, fax, Royal Mail or over the internet via the website. We are entitled to refuse any order placed by you and will not be required to provide an explanation.
You must be resident in the United Kingdom.
We are not obliged to supply the goods or services to you until we have confirmed acceptance of your order. It is on our acceptance and generation of an online invoice that a contract comes into effect between us.
Ownership of the goods transfers when we have been paid in full and delivery has taken place.
All products are supplied subject to availability. In the event that we are unable to supply any product, we will inform you of this as soon as possible.
Occasionally a manufacturer may change the specifications of a product. Should this happen to a product you have ordered from us we will endeavour to offer you a substitute product of no less specification and equivalent price. All sizes and dimensions are approximate and pictures may only be representative but we make every effort to make sure they are as accurate as possible.
PRICES AND PAYMENT
Where limited offers are advertised, these products are subject to availability and are allocated on a strict first come first served basis. When all the stock of these products has been allocated, no substitute product will be offered.
We have selected our products on the basis that they will be used for domestic use only. If you are planning to use them for business purposes please make sure that you have appropriate insurance. Midway UK accepts no liability whatsoever where products are misused or not used in accordance with instructions.
The price you pay is the price displayed on this website at the time we receive your order apart from the following exception. While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. We are not obliged to provide a product to you at an incorrect (lower) price.
These prices include VAT but exclude delivery costs.
Payment can be made by any method specified in our Payment Options section. We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are grossly negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.
INTERNATIONAL ORDERS
After a strategic review of Customs export and import restrictions on most of the products, we have regrettably decided that we are no longer able to accept or process orders for international customers outside the UNITED KINGDOM (UK).
We would like to take this opportunity to thank you for your valued custom in the past and apologise for any inconvenience this may cause.
DELIVERY SCHEDULE
Delivery should be achieved within 7-10 working days. We make every effort to deliver goods within the estimated timescales, however delays are occasionally inevitable and time for delivery will neither be of the essence nor will it be a fundamental term of the contract between us. We will endeavour to keep you informed of any delay to your expected delivery date.
You are responsible for ensuring availability to receive delivery of your product(s) and the delivery destination are suitable for delivery.
DELIVERY CHARGE
For UK Mainland orders a flat rate of £8.85 (inclusive of VAT) will be charged for carriage irrespective of the item quantity, size and weight of the order. All orders over £150 delivered to the UK Mainland are carriage free. All orders are delivered by a courier service.
BACK ORDERS
Midway UK hold 99.7% stock levels on all products listed. If your item is not in stock, we will back order for you. You will always be emailed with the option to cancel your order if you would rather not wait. If Midway UK cannot obtain a back order we reserve the right to refund without obligation.
CREDIT CARD SECURITY
All credit card numbers are encrypted when the order is placed using 128 bit encryption. They are only decrypted after they reach us. They are not held in clear text on any web site.
PRIVACY POLICY
Midway UK do not disclose buyers' information to third parties. Cookies are used on this shopping site to keep track of the contents of your shopping cart once you have selected an item, to store delivery addresses if the address book is used and to store your details if you select the 'Remember Me' Option.
Data collected by this site is used to:
a. Take and fulfil customer orders
b. Administer and enhance the site and service
c. Only disclose information to third-parties for goods delivery purposes
RETURNS POLICY
We hope that you will be completely satisfied with your product. However, it may be necessary to return your product to us in some limited circumstances. Please ensure that you follow these instructions for returning a product to avoid a delay in processing your return.
You will be responsible for the charges incurred in returning an item to us unless we agree to reimburse you elsewhere in these terms.
Returns will not be accepted unless they have a Returns Authorisation Number on the label. This number can be obtained by contacting our Returns Team in writing, by fax or by e-mail: sales@midwayuk.com.
You the Customer are solely responsible for inspecting the product upon delivery. You must contact Midway UK should you wish to inform us of damaged, defective or missing goods and/or delivery discrepancies within 48 hours of your delivery being made.
When sending a return to us, you are responsible for the safe carriage of the product back to us. Any product returned to us must be returned with all associated items originally sent as part of the product and in the same packaging. You should return any product to us via Royal Mail to the address given above with suitable insurance based on the value of the product. This means that the full value may be recovered by you if the product is lost or damaged. You should retain any receipt confirming the return. If returned products are lost we will not accept liability for them.
Refunds will be processed and a decision issued within thirty (30) days from the date you tell us of a product return or the day we confirm to you that you are entitled to a refund and refunds will not be issued until the product has been received by us in its original or delivered state.
DISTANCE SELLING REGULATIONS
Under the Distance Selling Regulations you have the right to cancel your order for any item purchased on our website or through our returns team and claim a full refund. To cancel your order you must notify us within seven (7) working days commencing on the day after delivery. You must return the product to us at your own cost as required by these Terms but if you do not or if you return the product to us at our expense then we may charge you the reasonable costs of returning a product except in the case of cancellation of substitute products.
Should you wish to exercise your rights under the Distance Selling Regulations your order may only be cancelled in writing, by fax or by e-mail: sales@midwayuk.com . Telephone cancellations cannot be accepted.
The goods must be returned in an unused and re-saleable condition. You are responsible for the cost of safe carriage back to us and are strongly advised to arrange for adequate insurance to cover the product during its return journey.
The product should be returned within seven (7) working days from the date we receive your cancellation. If you are unable to return the product to us within seven (7) working days you must advise us.
UNWANTED OR INCOMPATIBLE GOODS
We are not obliged to accept the return of a product unless covered by the Distance Selling Regulations as outlined in Section 4 and you have notified us of cancellation in writing within seven (7) days of delivery.
We may, in our absolute discretion, accept products subject to the deduction of a handling and administration fee of 10% plus delivery costs. To find out whether this will be possible, please contact us by email: sales@midwayuk.com .
Should we accept the return of an unwanted or incompatible product, you are responsible for the cost of safe carriage back to us and you will bear the risk during carriage until the product is received by us therefore you are advised to organise appropriate insurance to cover the return journey.
DAMAGED, DEFECTIVE OR FAULTY GOODS
Any product supplied to you must be used for its intended purpose and not be subject to abuse or unreasonable usage. Damage to goods in postage can be claimed from the carrier's insurance.
Midway UK Ltd or our authorised agent will repair or replace any product that has failed in normal usage and will reimburse the costs of returning the goods to us, and subsequently retuning the goods to you, as long as the product has been used as intended and does not, on examination, display any signs of misuse. If the product does display signs of misuse, then you will be responsible to pay our costs and expenses of examining the goods and subsequently, if you instruct us to, returning the goods to you.
SPECIFIC KNIFE SALE TERMS
Our company policy states that we shall not supply knives of any kind (nor knife making materials or accessories), to persons under the age of 18 years. We regret that we cannot send knives to educational addresses. We supply knives solely for legitimate field, recreational, sports and utility use, or as collectable curios. We reserve the right to refuse a sale or terminate a contract should we have any reason whatsoever to believe that the person to whom we shall supply may be under the age of 18 years, or if we believe that the supply may contravene any other legislation affecting the sale of knives. Further, by entering into a contract with us for the purchase of a knife, you are hereby consenting to our undertaking such searches as may be reasonably to satisfy ourselves as to legislative compliance.
The following statements are made for the purpose of giving guidance, and cannot be viewed as comprehensive knife safety instructions. Ultimately, knife safety is your responsibility and common sense should be exercised at all times. A blunt or carelessly handled knife can cause serious injury. Keep a keen edge on your knife and exercise caution when sharpening the blade. Always use a Knife with proper due care and attention, and never use a knife as a pry bar or a screwdriver, or for a purpose for which it is not specifically designed. Never threaten anybody with a knife, even in jest, as this is a serious Criminal Offence. And never leave a knife where it might be accessible to a child, a minor or any third party.
EXPANDING AMMUNITION – BULLET HEADS
We cannot post expanding bullet heads direct to the customer, it is a legal requirement that all such ammunition be purchased face to face with a Registered Firearms Dealer (RFD) who will need to check your firearms certificate to ensure that you have a variation that entitles you to these items. All other bullets i.e. full metal Jacket, match and lead cast bullets can be shipped direct to you the customer.
If wish to purchase expanding bullet heads we will need you to provide us with your local RFD details and we will need to confirm that they will accept these on your behalf. If the RFD has an account with us we can ship to them, if not we will require them to fax their RFD certificate (we can do this on your behalf if you can supply us with their contact details). Once this is done you can place the order with their address as an ‘alternative delivery address’ when you place the order. Once this arrangement is in place all future orders from MidwayUK that require validation of your firearms certificate can be shipped to your local RFD.
